India uses the Nice Classification (11th edition) — 45 international classes covering every possible product and service. Filing in the wrong class means paying ₹4,500 for a certificate that protects nothing. Here is how to get it right in Chennai in 2026.

The Golden Rule

Trademarks are protected only in the classes you file. A cafe registered in Class 43 (food services) has zero protection against a competitor registering the same name in Class 25 (clothing). Read our trademark registration guide for base fees and timelines.

Goods Classes (1–34)

  • Class 3 — Cosmetics, soaps, perfumes (D2C beauty brands)
  • Class 5 — Pharmaceuticals, ayurveda, supplements
  • Class 9 — Software, mobile apps, downloadable content (SaaS goes here and Class 42)
  • Class 25 — Clothing, footwear, headgear (all apparel brands)
  • Class 29 & 30 — Packaged foods (dairy, snacks, spices — huge for Chennai FMCG)
  • Class 32 & 33 — Beverages (non-alcoholic and alcoholic respectively)

Services Classes (35–45) — the workhorses

  • Class 35 — Advertising, business consulting, retail store services, marketplaces. Every e-commerce Chennai brand needs Class 35.

  • Class 41 — Education, training, entertainment, publishing (edtech, coaching, content)
  • Class 42 — Software as a Service, IT services, technology consulting (SaaS)
  • Class 43 — Restaurants, cafes, cloud kitchens, hotels
  • Class 44 — Medical, wellness, beauty salons, clinics
  • Class 45 — Legal services, security services

Real Chennai Filing Mistakes We Have Fixed

  1. D2C skincare brand filed only in Class 3 (cosmetics). A copycat registered in Class 44 (beauty salons) and launched a franchise chain using the same name. Fix: we filed defensive marks in 35, 44 and 5.
  2. SaaS founder filed only in Class 9. Marketplace competitor claimed Class 42 for "software services". Fix: dual-class filing.
  3. Chennai cloud kitchen registered in Class 43 alone. Packaged food line was blocked by a Class 30 registrant. Fix: 30 + 43 combo before scaling.

Defensive Class Strategy

File in your primary class plus 1–2 defensive adjacent classes. For most Chennai service businesses the workhorses are 35, 41 and 42. Government fee is ₹4,500 per class (individual/MSME) or ₹9,000 (other entities) — register as Udyam MSME first to unlock the 50% rebate.

A class adjacent to your primary business (e.g. Class 35 for a Class 43 restaurant) that you register even without immediate use, to block competitors from entering under your name.

Can I amend the class after filing?+

No. Class cannot be changed after filing. You must file a fresh application in the correct class — the original fee is not refunded.
