Mutual Consent Divorce in Chennai: Process, Timeline & Costs (2026)

Mutual consent divorce is the fastest, least damaging way to end a marriage in Chennai — provided both spouses agree on separation, maintenance, custody and property. This guide explains how the Chennai family courts actually handle these petitions in 2026.

Under Section 13B of the Hindu Marriage Act (and equivalent provisions in the Special Marriage Act and Indian Divorce Act), spouses can file jointly if they have lived separately for at least one year and cannot reasonably live together. Petitions are filed in the family court where the marriage took place, where the couple last lived together, or where the wife currently resides.

Documents you need

  • Marriage certificate or marriage invitation with photographs
  • Address and identity proof of both spouses (Aadhaar, passport, voter ID)
  • Income proof, for maintenance and alimony terms
  • Photographs of the marriage and details of children, if any
  • A written settlement covering alimony, custody, visitation and asset division

The two-motion process and the cooling-off period

The first motion is the joint petition and recording of statements. A statutory six-month cooling-off period follows, after which the second motion is heard and the decree is passed. Since Amardeep Singh v. Harveen Kaur, family courts can waive the six-month wait where the separation has already been long and settlement terms are final — Chennai courts do grant waivers, but only with a properly drafted waiver application and clean settlement terms.

Realistic timeline

  • With waiver: roughly 2–4 months from filing to decree
  • Without waiver: roughly 7–12 months, depending on the court's board

Costs to expect

Court fees for a mutual consent petition are modest; the meaningful cost is professional fees for drafting the settlement, appearances and the waiver application. Ask for a written fee schedule up front. If the settlement collapses mid-way, the matter converts into contested litigation — which is far more expensive, so investing in a watertight settlement deed at the start pays for itself.

Custody and maintenance in the settlement

Courts look closely at whether the child's welfare is genuinely protected. Specify who has physical custody, the visitation schedule, education and medical expense sharing, and how maintenance will be paid and revised. Vague terms are the single biggest reason mutual consent petitions get adjourned.

Frequently Asked Questions

Can we get a mutual consent divorce in Chennai without waiting six months?+

Yes, in appropriate cases. Family courts can waive the six-month cooling-off period when the spouses have already lived apart for a long time and every term of the settlement — alimony, custody, property — is finalised. A separate waiver application must be filed and argued.

Do both spouses have to appear in court in Chennai?+

Both parties must appear for recording of statements in both motions. Where one spouse is abroad, courts may permit appearance through a power of attorney holder or video conferencing, but this is discretionary and should be requested in advance.

Is mutual consent divorce cheaper than a contested divorce?+

Substantially. Contested divorces in Chennai routinely run several years with interim maintenance applications and appeals. A well-drafted mutual consent petition usually concludes within a year at a fraction of the cost.

Can maintenance be reopened after the decree?+

A properly recorded full-and-final settlement is generally binding between spouses, but a child's right to maintenance cannot be contracted away and can be revisited by the court.
